The purpose of this website is to provide information and facilitate the booking of tourist accommodation. Located in Cabo de Gata, Almería. Through it, the user can check accommodation features, availability, prices, and make reservation requests.

 

Terms of Use

Access and/or use of this website confers the status of user, who accepts, upon such access and/or use, these terms of use. The user agrees to make appropriate use of the content and services offered, and not to use them to engage in illegal activities or activities contrary to good faith and public order.

 

Intellectual and Industrial Property

All content on the website, including, but not limited to, texts, photographs, graphics, images, icons, technology, software, graphic design, source code, and other audiovisual or audio content, as well as its graphic design and source code, are the property of the owner, and none of the exploitation rights recognized by current intellectual property regulations may be understood to be transferred to the user.

Data Protection

The personal data collected through the website will be processed in accordance with the provisions of the [Privacy Policy], in compliance with Regulation (EU) 2016/679 (GDPR) and Organic Law 3/2018 on the Protection of Personal Data and the Guarantee of Digital Rights (LOPDGDD).

 

Liability

The owner is not responsible for errors or omissions in the content of the website, nor for any damages that may arise from its use, nor for the actions of users who violate the provisions of this Legal Notice.

 

Applicable Law

These terms and conditions are governed by Spanish law. For the resolution of any dispute that may arise from access to this website, the user and the owner expressly agree to submit to the courts and tribunals of Almería, waiving any other general or special jurisdiction that may apply.

Payment and cancellation terms

1.⁠ ⁠Reservation

-⁠A reservation request will be held as an option for a maximum of 2 days.

-Without final confirmation within this period, the house may be rented to another party.

-⁠A reservation is only final after written confirmation by email.

 

2.⁠ ⁠Payment and acceptance of terms

-⁠Upon reservation, 50% of the rental amount is due.

-The remaining balance must be paid no later than 6 weeks before arrival.

-⁠If you book within 6 weeks prior to arrival, the full amount is due immediately.

-⁠In case of cancellation more than 6 weeks before the start of the rental period, 50% of the deposit will be refunded. If cancellation occurs within 6 weeks, no refund will be made. We therefore recommend taking out a cancellation insurance.

-By paying (part of) the rental amount, you agree to these general terms and conditions.

 

3.⁠ ⁠Cancellation by guest

-Up to 6 weeks before arrival: 50% refund, provided the full amount has been paid.

-⁠Within 6 weeks before arrival: no refund.

-We recommend taking out travel and cancellation insurance.

-If the guest wishes to cancel the booking, they must notify the owner by email. The date the cancellation email is received determines which part of the rental fee is due.

-The deposit will always be refunded.

 

4.⁠ ⁠Cancellation by owner

The owner may cancel the reservation due to force majeure or unforeseen circumstances, such as (but not limited to):

-Natural disasters or damage to the property

-Sudden sale of the property

-A double booking

In such cases, the full amount paid will be refunded. No further compensation will be provided. The owner is not responsible for costs of services booked independently by the guest, such as flights, car rental, bus/train travel, ferry crossings, etc.
